Last June, in the Bostock decision, a healthy Supreme Court majority ruled that “sex” under Title VII includes sexual preference and sexual orientation. The Court also concluded that an affirmative action admissions program at the University of Texas satisfied the due process and equal protection clauses of the 14th Amendment.
